Every bar and restaurant selling vapes needs an ABC tobacco permit by October 1

Virginia's retail tobacco permit takes effect October 1, 2026. It covers restaurants and bars, not just smoke shops, and ABC says applications take 20 to 30 days. The window to be legal on day one is closing now.

If your restaurant sells a single vape, a tin of pouches, or a pack of cigarettes, you need a Virginia ABC retail tobacco permit by October 1, 2026, and you probably needed to apply already.

This is not a smoke-shop rule. Virginia ABC defines a retail tobacco establishment to include “any grocery store, retail tobacco product shop, kiosk, convenience store, gasoline service station, bar, or restaurant” selling retail tobacco products to the public.

The arithmetic that should worry you

Virginia ABC says it anticipates processing online applications within 20 to 30 days. Paper applications take longer.

Count backward from October 1. An application filed in the first week of September lands inside the window, barely. An application filed at the end of September does not, and selling without the permit after October 1 can carry a misdemeanor criminal charge.

If you have not applied, apply this week, online, not on paper.

Holding an ABC license already saves you a hundred dollars. Permits are valid for 12 months from issuance, and ABC sends a renewal notice roughly 60 days before expiration. Renewal fees had not been published as of this writing.

What counts as a tobacco product

Broader than most operators assume. The permit covers cigarettes, heated tobacco products, chewing tobacco, snuff, snus, electronic smoking devices, liquid nicotine, vaping substances, and accessories including blunt and hemp wraps and glass pipes.

Read that accessory list again. A restaurant that sells no tobacco at all but keeps hemp wraps behind the bar is in scope.

The one exception: a business selling only cigars or pipe tobacco is exempt. If you run a cigar program and nothing else, you are outside this. Add a single vape and you are inside it.

The $5,000 problem nobody mentions

Separate from the permit, and arguably more dangerous: every vape product you sell must appear on the Virginia Attorney General’s approved product directory. Civil fines for selling off-directory products start at $5,000.

That is not a per-store fine at the low end of a range. That is the floor.

Nicotine vapor manufacturers were required to register with the Attorney General’s office and appear in the Liquid Nicotine and Nicotine Vapor Products Registry by December 31, 2025. Products whose manufacturers did not register are not legal to sell here, regardless of whether your distributor is still shipping them.

Pull your vape SKUs and check every one against the directory. This is the single highest-dollar exposure in this article, and it is entirely avoidable with an afternoon of inventory work.

Your staff needs VERT

Employees must complete VERT, Virginia Education for Retailers of Tobacco. It is a free online program covering ID checking, signage and prohibited acts.

Free and online means there is no excuse for it not being done before October 1. Build it into onboarding the way you already should have with alcohol server training.

The other license moving underneath this

If you sell liquid nicotine or vapor products, there has been a separate license administered by Virginia Tax, applied for on Form TT-10 with a $400 fee, background checks included for initial applicants and $100 for subsequent ones. Operating without it carried a penalty of up to $400 per location.

As of October 1, that licensing responsibility transfers to Virginia ABC. If you have been dealing with the Department of Taxation on nicotine licensing, your counterparty is changing.

What to do, in order

  1. Apply online today if you sell anything on the covered list. Twenty to thirty days is the estimate, not the guarantee.
  2. Audit your vape inventory against the Attorney General’s directory. Anything not listed comes off the shelf now. $5,000 is the floor.
  3. Run your staff through VERT. It is free.
  4. Check whether you are actually exempt. Cigars and pipe tobacco only means only. Hemp wraps and glass pipes count.
  5. Note the transfer from Virginia Tax to ABC on October 1 so renewal notices do not go to a dead contact.

Why this lands hard on hospitality

Restaurants and bars are used to thinking of themselves as ABC licensees for alcohol. A great many of them also sell a handful of nicotine products at the register almost as an afterthought, without ever thinking of themselves as tobacco retailers.

October 1 makes that afterthought a permit, a background check, a training requirement and a criminal exposure. The permit fee is trivial. The processing time and the $5,000 directory floor are not.
