Altria Group, headquartered in Henrico County, filed suit against the Food and Drug Administration in federal court in Lubbock, Texas on September 2, alongside co-plaintiffs including the Texas Food and Fuel Association.

The claim is procedural and blunt: federal law requires the FDA to decide a premarket tobacco product application within 180 days, and Altria says the agency has never met that deadline. Some of its applications have been pending more than six years. Applications the agency itself put on a fast track remained under review past its own December 2025 target.

The products at issue include on! nicotine pouches and flavored and unflavored vapes. The company is asking the court to set aside the current review system and compel the FDA to build a new one.

The FDA did not immediately respond to a request for comment.

Why a Virginia hospitality publication cares

Two reasons, and neither is about Altria’s share price.

The retail tobacco permit took effect in Virginia on October 1, and it applies to restaurants and bars that sell any nicotine product, not only to smoke shops. The permit is one obligation. The Attorney General’s approved product directory is the other, and civil fines for selling an off-directory vape start at $5,000.

That directory exists downstream of the federal approval process. When applications sit for six years, the set of products a Virginia retailer can lawfully stock is shaped less by what customers ask for than by which applications happened to clear. A retailer’s compliance problem and Altria’s litigation are the same bottleneck viewed from opposite ends.

Second, this is a Virginia employer. Altria is one of the largest corporate presences in the Richmond region, and the outcome affects a workforce that lives here.
